This document sets out the legally binding terms (“Terms”) governing your access to and use of Curlit’s website curlit.shop, our related sub-domains, apps, and any services we provide (collectively, the “Services”). By visiting or using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, please stop using the Services.

1. Definitions

• “Curlit” / “we” / “us” — Curlit, 24 Nozha St., Ard El Golf, Cairo, Egypt, and its affiliates.
• “User” / “you” — anyone who browses, purchases from, or otherwise interacts with the Services.
• “Products” — Curlit’s cosmetic and hair-care items, accessories, gifts, and digital content offered for sale.
• “Site” — curlit.shop and any successor domain.
• “UGC” — user-generated content (reviews, photos, videos, comments, social posts, etc.).

2. Acceptance & Modification of These Terms

By accessing or using the Services, creating an account, or placing an order you acknowledge that you have read, understood, and agree to be bound by these Terms. We may update them from time to time. Material changes will be announced on this page and, where practicable, by email 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.

3. Eligibility

• You must be at least 18 years old or the legal age of majority in your jurisdiction. Minors require verifiable guardian consent.
• You warrant that any registration or payment information you provide is accurate and complete.

4. Account Registration & Security

• Accounts speed up checkout and allow access to loyalty points. Keep your password confidential; you are responsible for all activities under your login.
• We may suspend or terminate any account that: (a) provides false information; (b) engages in fraud; (c) abuses the Site; or (d) breaches these Terms or applicable Egyptian law.

5. Products, Pricing & Availability

• All prices are shown in Egyptian Pounds (EGP) and include VAT where applicable, unless we clearly state otherwise.
• We strive to keep product descriptions, images, ingredients, and availability accurate. However, colours may vary by screen, and stock levels are subject to change without notice.
• We reserve the right to limit quantities or discontinue any Product at any time.

6. Ordering Process & Contract Formation

1. Offer: Your cart submission constitutes an offer to purchase.
2. Acknowledgment: You will receive an automatic “Order Received” email.
3. Acceptance: A binding contract forms only when we email you an “Order Confirmation” or ship the Products, whichever happens first.
4. We may refuse or cancel any order before acceptance (e.g., pricing error, suspected fraud, or delivery restrictions). If payment was captured we will refund it using the original payment method.

7. Payment Terms

• We accept major credit/debit cards, Paymob, Fawry, cash-on-delivery, and other methods displayed at checkout.
• By submitting payment details you confirm you are authorised to use that method.
• We (or our payment gateway) may run standard pre-authorisation checks. All card data is tokenised; we never store full card numbers on Curlit servers.

8. Shipping, Delivery & Title

• Estimated delivery windows are shown at checkout and begin once the order is accepted.
• Risk and title pass to you upon delivery to the address you provide.
• Shipping fees are non-refundable unless (a) the Product is defective, (b) we shipped in error, or (c) required by consumer-protection law.
• Delays caused by customs, strikes, force-majeure events, or inaccurate address details are outside our control.

9. Returns, Exchanges & Refunds

• You have 14 calendar days from receipt to return unopened Products for a full refund, per Article 30 of Egypt’s Consumer Protection Law 181/2018.
• Products must be unused, sealed, and in their original packaging with proof of purchase.
• Opened cosmetics and personal-care items cannot be returned for hygiene reasons unless faulty.
• Refunds are issued to the original payment method within 10 working days of our receipt and inspection of the return.
• Return shipping costs are your responsibility unless we made an error or the item is defective.

10. Promotions, Coupons & Loyalty Points

• Coupons, promotional codes, and loyalty points have no cash value, are non-transferable, and may not be sold.
• Specific terms (expiry, minimum spend, exclusions) are stated on the offer. We may amend or terminate promotions at any time, but will honour rewards already earned.
• Misuse (e.g., creating multiple accounts) may lead to points or coupons being voided.

11. Intellectual Property

The Services, including all text, graphics, logos, icons, images, product names, videos, code, and compilations are the property of Curlit or its licensors and are protected by Egyptian copyright, trademark, and unfair-competition laws. Except where permitted by law, you may not reproduce, modify, distribute, or exploit any part of the Services without our prior written consent.

12. User-Generated Content (UGC) Licence

• By submitting UGC (reviews, photos, videos, social-media tags such as #curlit or @curlit.shop) you grant Curlit a worldwide, royalty-free, perpetual, irrevocable licence to use, edit, reproduce, distribute, and display that UGC in any media for marketing or other commercial purposes.
• You represent that you own the UGC, it is original, non-infringing, not defamatory, and complies with applicable laws.
• We reserve the right to remove or refuse any UGC at our discretion.

13. Prohibited Conduct

You agree not to:

• Use the Services for any unlawful purpose or to solicit others to perform unlawful acts.
• Upload or transmit viruses, malware, or any code of a destructive nature.
• Scrape, crawl, or harvest the Site or bypass our security measures.
• Impersonate Curlit, a Curlit employee, or another user.
• Reverse-engineer, decompile, or disassemble any software used in the Services.

14. Third-Party Links & Tools

The Services may contain links to or use integrations (e.g., payment widgets, social-media feeds) from third-party sites. We do not control these sites and are not responsible for any content, products, or services they provide. Accessing third-party sites is at your own risk and subject to their terms and policies.

15. Medical & Allergy Disclaimer

Curlit Products are cosmetics, not medical treatments. Information on the Site is for general education only and is not a substitute for professional medical advice. Always conduct a patch test before first use. Discontinue use if irritation occurs and consult a dermatologist.

16. Warranty Disclaimer

Except as expressly required by Egyptian consumer law, all Products and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

17. Force Majeure

Curlit is not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, epidemics, government actions, war, labour disputes, or interruptions of transportation or utilities.

18. Limitation of Liability

To the fullest extent permitted by law, Curlit (including its directors, employees, and agents) is not liable for any indirect, incidental, punitive, or consequential damages arising from or related to the Services. Our total aggregate liability for any claim shall not exceed the total amount you paid Curlit for the Product or Service giving rise to the claim.

19. Indemnification

You agree to defend, indemnify, and hold harmless Curlit from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of a third party.

20. Electronic Communications & Signature

By using the Services you consent to receive electronic communications from Curlit (order confirmations, legal notices, marketing with prior opt-in). You agree that electronic signatures and contracts are legally binding under Egypt’s Electronic Signature Law 15/2004.

21. Privacy & Data Protection

All personal data is processed in accordance with our Privacy Policy and Egypt’s Personal Data Protection Law 151/2020 (“PDPL”). By using the Services you consent to such processing.

22. Modification, Suspension & Termination of Services

We may modify, suspend, or discontinue any part of the Services at any time (e.g., for security, maintenance, business reasons) without liability. We will provide reasonable notice where practicable.

23. Export Controls & Sanctions

You agree not to export or re-export any Product to countries or entities subject to Egyptian, US, EU, or UN sanctions. You further represent you are not located in a country subject to such sanctions.

24. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Arab Republic of Egypt. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent Egyptian courts. Consumers may also seek amicable settlement through the Consumer Protection Agency.

25. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

26. No-Waiver

Our failure to enforce any right or provision under these Terms shall not constitute a waiver of that right or provision.

27. Assignment

Curlit may assign or transfer its rights and obligations under these Terms to another entity (e.g., in connection with a merger or acquisition). You may not assign your rights without our prior written consent.

28. Entire Agreement

These Terms, together with any policies referenced herein (e.g., Privacy Policy, Return Policy), constitute the entire agreement between you and Curlit and supersede any prior agreements or communications.

29. Notice Procedures

Legal notices to Curlit must be sent by courier to 24 Nozha St., Ard El Golf, Cairo, Egypt, with an email copy to legal@curlit.shop. We may provide notices to you via the email address on your account or, for Users without an account, by posting on the Site.

30. Headings

Section headings are for convenience only and do not affect the interpretation of these Terms.
